Terms of service

This site is operated by BBALL JUNKIES, a lifestyle basketball brand rooted in Southern California and established in 2007. These terms cover your use of the site and every order placed through it. Placing an order means you accept them; if you do not accept them, do not order.

Who you are buying from

You are buying from BBALL JUNKIES, INCORPORATED, a California corporation. It sells direct, from Southern California, and only through this site. Written correspondence goes to 1192 E. Imperial Hwy, PMB# 1077, Placentia, CA 92870, which is a mailing address and not a shop. The contact information policy lists every way to reach us.

Products, prices, and availability

Product photographs are of the real garment, and color shifts a little from screen to screen. Every run is limited and some items are made to order, so a size can sell out between the moment you put it in the bag and the moment you pay.

Prices are in U.S. dollars and can change without notice. We work to keep prices, stock, and descriptions right; where something is wrong we may correct it, and we may cancel and refund an order placed against an obvious error — a price that is plainly a typing mistake, or an item we turn out not to have. We will tell you and refund you in full rather than substitute something you did not choose.

Orders

Your order is an offer to buy. We accept it when we ship it, and until then we may decline it — for suspected fraud, for a payment we cannot verify, or for stock we turn out not to have. An order we decline is refunded in full.

Title passes to you when we hand your order to the carrier.

To cancel, write to us straight away. If it has not been printed or packed, we cancel it and refund it. After it ships the refund policy applies, and under that policy all sales are final except for damaged, defective, or incorrect goods, with return postage paid by the customer. The one other refund is an international parcel that is refused or unclaimed and comes back to us, refunded less the original shipping and the return postage.

Payment

Payment is taken at checkout by our payment processors; we never see or store your full card number. Sales tax is calculated at checkout where we are required to collect it. Shipping charges, duties, and import taxes are covered by the shipping policy.

The designs are ours

The marks, logos, artwork, garment designs, photographs, and written content on this site belong to BBALL JUNKIES and are protected by copyright and trademark law. Buying a garment buys you the garment; it does not license the artwork on it. Do not reproduce our designs, produce counterfeit or derivative product, or use our marks or photography commercially without our written permission. Wearing it, photographing yourself in it, and posting that is what the product is for, and none of this is aimed at you doing so.

Using the site

Do not try to break, overload, or gain unauthorized access to this site, do not scrape it at scale, and do not use it to break the law. We can withdraw access where any of that happens.

What we do not promise

The site is provided as it stands. We do not promise it will be uninterrupted or free of errors, and we are not responsible for what is on sites we link to.

Nothing in these terms waives the implied warranty California law attaches to new consumer goods sold at retail, and nothing here excludes liability for fraud or any other liability that cannot lawfully be excluded. Subject to that, our total liability to you in connection with an order is limited to what you paid for that order, and we are not liable for indirect or consequential loss.

Governing law

These terms are governed by the law of the State of California, without regard to its conflict-of-laws rules, and any dispute is to be brought in the state or federal courts serving Orange County, California. If you are a consumer, this does not remove the protection of the law where you live, where that law says it cannot be removed.

Changes

We can change these terms. The version that governs your order is the one published when you placed it, and the date below says when this one was last touched.
